Terms of Service
Effective: January 1, 2026
These Terms of Service ("Terms") govern your access to and use of mybodytonic.com and any telehealth services provided by Body Tonic LLC ("Body Tonic RX"). By using the Site or services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old, a U.S. resident in a state where we are licensed to provide care, and able to form a legally binding contract. You agree to provide accurate information during registration and intake.
2. Telehealth services; not an emergency service
Telehealth services are provided by independently licensed clinicians. Do not use the Site for medical emergencies. Call 911 or go to the nearest emergency room. Use of the Site does not establish a provider-patient relationship until a clinician accepts your case after intake review.
3. Prescriptions
Any prescription is at the sole discretion of the prescribing clinician based on medical necessity. We do not guarantee that any consultation will result in a prescription. We do not prescribe controlled substances via telehealth.
4. Fees
Consultation, membership, lab, and medication fees are presented at checkout. We do not bill insurance for telehealth services. Charges are non-refundable once a clinician has reviewed your intake, except as required by law or as set forth in our Shipping & Returns policy.
5. Acceptable use
- No misrepresentation of identity, age, or medical history.
- No reselling, sharing, or diverting medications obtained through Body Tonic RX.
- No attempts to disrupt, reverse-engineer, or scrape the Site.
6. Intellectual property
The Site, branding, content, and software are owned by Body Tonic LLC and protected by intellectual property laws.
7. Disclaimers; limitation of liability
The Site is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Body Tonic LLC is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the prior 12 months.
8. Governing law; dispute resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute will be resolved by binding arbitration in Travis County, Texas, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.
9. Changes
We may update these Terms. Continued use after changes constitutes acceptance.
